Many companies will suffer the legal and financial effects of failing to manage the privately-owned cars of employees being driven for business – increasingly referred to as ‘grey fleet’ - if they are not managed to the same standards as other company cars. They can also expose their employees to health and safety breaches, further increasing their vulnerability.

Any employee of a company that uses a privately owned or hired vehicle for business use is part of a company’s grey fleet. It’s estimated that more than half of all public sector miles are ‘grey fleet’ journeys.
The need for employers to demonstrate their duty of care is underpinned by the Corporate Manslaughter and Corporate Homicide Act (2007) as is conforming to the pre-existing Health & Safety At Work Act and Management of Health and Safety at Work Regulations.
If a privately-owned car being driven for business is involved in a road crash, the driver and the company could face a police investigation. The company could also be questioned about their at-work driving management policies and procedures.
